Exactly. Ginsberg’s complaint about the Roe decision was more that it went too far. She would have stopped the Texas law as too restrictive, but left the abortion issue to be resolved through the normal evolution of case law, if not through legislation.
Griswold was founded on liberty and privacy. Liberty was found in the 14th Amendment and privacy was found in the 4th. The 9th Amendment was also sited as well as due process of the 14th. Roe was built upon the logical extension of Griswold. The fear now is that future case law will be built upon Alito.
But I think many are missing the point. The Roe trimester test seems to have worked rather well. It is a classic compromise, as is our Constitution. Something for everyone, everything for no one. Such is democracy; no?
