I’ve read their decision, and the Colorado supreme court decision. They both completely trash any and all arguments against application of the 14th Amendment, Section 3. Colorado directly, and DC Appeals indirectly. The real beauty of the appeals court decision was the way it was [not so] subtly aimed at SCOTUS in the Colorado case tomorrow. Quoting C.J. John Marshall in the Marbury decision where Marshall refers to the president as an “officer” several times [page 21], thus demolishing Trump’s argument that the president is not an “officer” under the Constitution.

The appeals court decision is beautiful in both logic and common sense. Would that SCOTUS be guided by it; their decision should also be Per Curiam.
