Let me clarify what is going on here. Judge Wallace found the FACT that Trump engaged in insurrection. Finding FACTS are what trials are for.
The appeals court is to decide what the LAW is.
The only real question for appeal is, Is the Presidency an 'office' under the United States? Wallace said, essentially, that she did not know the answer. If you read the Constitution the answer is clear. The text of the Constitution mentions the Office of the President at least 25 times.
If the appeals court decides that the Presidency is indeed an office under the United States, and since the FACT has already been decided, then the connection between the two is clearly established:
1.) FACT - Trump did engage in insurrection against the United States.
2.) LAW - Trump is disqualified from holding any office under the United States.
It remains to be seen whether any appellate court, or SCOTUS, has the balls to enforce the 14th Amendment as it is written.
