The Colorado court decision demolished the ‘officer’ argument as well as other complaints so much so that Judge Luttig called it “ironclad.” SCOTUS would have to twist itself into knots to reverse it, but the conservative majority has that down to a science. SCOTUS would lose even more public legitimacy, if they care.
The dissenters in Colorado offered the only possible way to reverse: Lack of due process. SCOTUS may go for that, but that only opens up avenues in every other state to pursue Trump’s guilt of insurrection as a fact at trial. As with abortion, the states would become a patchwork of conflicting rulings and conflicting access to Trump’s name on state ballots.
As with abortion, the “United” States would become more divided than ever.
Buckle up. It’s going to be a bumpy ride.
